This Website is operated by Positive Lighting Solutions Ltd trading as positivelightingsolutions.co.uk (referred to as "we/our/us/the copmany"). As a user of this website (referred to as "you/your") you acknowledge that any use of this Website including any transactions you make are subject to our Terms and Conditions below.
1. General
1.1 Our Terms and conditions do not affect your statutory rights.
1.2 Please print off a copy of our terms and conditions for your records.
1.3 The following terms and conditions apply to all transactions received by Positive Lighting Solutions via the Internet, e mail sales@positivelightingsolutions.co.uk, mail, and telephone. These being the only methods accepted by Positive Lighting Solutions. In order to order goods through any of these methods you must be at least 18 years of age and be able to accept delivery within the United Kingdom.
1.4 Our Terms and conditions are subject to change at any time without prior notice to you.
2. Description of Goods
2.1 Only brief specifications are listed. Please contact us if you require further information.
2.2 All the images and descriptions are representative of the products supplied to Positive Lighting Solutions by the manufacturer. All products are subject to change or upgrade at the manufacturers discretion.
2.3 The product information shown has been supplied by manufacturers and suppliers. Positive Lighting Solutions keep this as accurate and up to date as possible. The information relating to specification, accessories, special offers and promotions may change without prior notice.
3. Ordering and Pricing
3.1 All products offered on our website are subject to availability and may be withdrawn at any time. If for any reason we are unable to supply goods we will not charge you and any monies paid will be refunded in the same method as received. Positive Lighting Solutions will not be responsible for compensation if we are unable to supply any goods or compensate for any other losses incurred by you.
3.2 . If a product ordered is out of stock we will notify via e mail or telephone. We will attempt to dispatch the product within a period of no longer than 14 days. If the expected delay is likely to be longer we offer the option of a full refund of monies paid. We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in delivering the goods.
3.3 Any product displayed as Special Order will not be accepted for refund unless faulty, as it will have been specially ordered for you and may not be resold. We can only advise delivery schedules from information given to us by our manufacturers or suppliers so cannot guarantee this information.
3.4 Orders can be placed via our Secure Online Server (using Protx and Paypal) and Whichever method you use all required fields must be completed in full and correctly for your order to be processed.
3.5 All orders are verified for the security of both you and us. You may be asked for further information such as proof of address or identity before your order can be processed. False information may result in your order being delayed or rejected.
3.6 We cannot be held responsible for inaccurate information given during any telephone conversation or order.
3.7 In the event that a product is listed at an incorrect price due to a typing error or pricing error we shall have the right to refuse or cancel any orders listed at the incorrect price even if the order has been confirmed. We will notify you of the correct price, giving you the opportunity to cancel the order and have a refund of any monies paid if the order is cancelled.
3.8 All prices are inclusive of 17.5% V.A.T. (unless stated) and exclusive of delivery charges which will be payable as indicated at the time of ordering. The total price payable will be stipulated at the time when you place your order whether the order is confirmed or not.
3.9 Products, prices and promotions are valid only for the period which they are displayed (unless stated) and are all subject to availability. If any of these should change to your detriment or become unavailable in the period after you placed your order with us, you will be contacted before we proceed with your order.
4. Payment and Ownership of Goods
4.1 Positive Lighting Solutions accepts most major credit/debit cards including MasterCard, Visa, Maestro (Switch), Solo, Delta. You must provide us with your exact billing address and telephone number, which is held with your credit/debit card company. Incorrect information will lead to delays or refusal of your order being processed.
4.2 Card payments will be taken via Paypal. If any problems occur with any transactions we will contact you with further details.
4.3 Your order can only be processed once we have received an authorization code. Cheques and postal orders will take a minimum of 10 days to clear and only then can the goods be released for dispatch.
4.4 The purchaser will have ownership of the goods as soon as delivery has taken place which is after payment in full. All communications with Positive Lighting Solutions must be made by the purchaser only, relating to deliveries, collections or any other matter relating to the product or the order.
4.5 From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk.
4.6 We will issue you with an electronic invoice once the goods have been dispatched to you.
5. Delivery
5.1 We will only deliver goods to the address on the order and goods may require a signature. Various delivery methods are used including Royal Mail and national carriers depending on value and size of the product/s purchased.
5.2 Delivery of products from stock will normally be made within 1 to 3 working days of clearance of payment. Any accessories from stock that can be posted by 1st Class or Recorded Mail will be dispatched within 1 to 2 working days of cleared payment. Products are usually dispatched well inside these guidelines but sometimes delivery dates are beyond our control. Deliveries to remote parts of the United Kingdom such as Northern Scotland, areas of Southern England and rural areas etc may take a little longer.
5.3 If goods arrive in a damaged condition you must write a brief description of the damage on the delivery note and is your responsibility of informing us within 3 days from delivery date, quoting the delivery note or invoice number.
5.4 It is your responsibility to notify us of any in-correct goods delivered within 3 days from date of delivery, quoting the delivery note or invoice number. It is also your responsibility to sign for the correct number of packages as shown on the carrier's delivery note, any shortages must be noted on the delivery note and you must notify us within 3 days from the delivery date, quoting the delivery note or invoice number.
5.5 We will not accept liability for goods lost in transit unless we are notified within 7 working days from the expected delivery date. If goods returned under this clause are found to be perfect and in full working order, they will be returned to you and an administration fee of 20% of the price of the goods along with the cost of carriage will be charged to your credit/debit card.
5.6 We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay of the goods purchased.
5.7 We do not deliver any orders outside of mainland United Kingdom.
5.8 All prices on our website are exclusive of delivery charges which will be added at the checkout. Delivery charges are for most of mainland United Kingdom. Some Scottish Highlands and remote rural areas of the United Kingdom may incur additional charges and also longer delivery dates, as will deliveries to inner city areas that have charges for entering.
6. Product Warranty
6.1 All products supplied are covered by the terms and conditions with a warranty period of 12 months from date of purchase.
7. Faulty Goods
7.1 If a product is deemed to be faulty upon arrival then you must contact us within 7 days from the delivery date. Any goods to be returned to Positive Lighting Solutions may be subject to a handling charge unless due to mis-delivery, error, breakage, or fault. All returns should be accompanied by the number of the original purchase invoice. If goods are returned without the original purchase invoice there may be delay in the processing of the credit, also the amount credited may vary from the original purchase amount.
7.2 If a product returned to us as faulty and we find that there is no fault, you will be offered the following options. A). Return of the goods and the delivery charged to you. B). Refund, less any applicable delivery, collection and inspection costs. C).If the condition of the product or packaging is of a poor condition (not as new) we reserve the right to charge to cover re-packaging, replacing missing accessories or damage to the goods. D). If the customer refuses to take such goods back you may be liable to a 25% handling/restocking fee off the purchase price.
7.3 The guarantee will apply to all items reported to be faulty after 7 days from the date of delivery.
7.4 We strongly advise all customers to retain boxes and packaging where possible as you will be solely responsible for any damage caused to non original packaging.
8. Damages or Non Delivery
8.1 All shortages, faults, breakages, errors and mis-deliveries must be notified to Positive Lighting Solutions within 24 hours of delivery.
8.2 Any goods to be returned to Positive Lighting Solutions may be subject to a handling charge unless due to mis-delivery, error, breakage, or fault. All returns should be accompanied by the number of the original purchase invoice. If goods are returned without the original purchase invoice there may be delay in the processing of the credit, also the amount credited may vary from the original purchase amount.
9. Returns and Distance Selling Policies
9.1 In line with the distance selling regulations 2000 Positive Lighting Solutions requires you to send a notice of cancellation in writing within 7 working days via e mail sales@positivelightingsolutions.co.uk, informing us of your details including customer account number and invoice number stating the reason for cancellation of the goods. You must return the goods at your expense. The authorization number is valid for 14 days. A telephone call is not enough to constitute a cancellation. Goods under 14 days will follow the same guidelines below but will be replaced or refunded.
9.2 If you decide to exercise your right to cancel under the 7 day regulation the ownership of the goods will revert to Positive Lighting Solutions.
9.3 The 7 and 14 days return regulations impose the responsibility of the customer to take reasonable care of any goods supplied. This obligation applies before as well as after the customer has given notice of cancellation. The 7 days provision is designed to ensure that the goods can be sold as brand new again. The customer will be wholly responsible under this regulation for the cost of the return delivery and all damages of the goods. We deem reasonable care as meaning that the goods are in perfect condition with all of the box and packaging intact. Where applicable any accessories must be unopened. Products that have not been agreed by Flash Novelties for return will not be accepted and be refused. Goods that do not fall into the above criteria and not resalable as new will be subject to a minimum 25% handling fee off the original purchase price or returned back to you. 10. Personal Information
10.1 Information collected by Positive Lighting Solutions at the time of ordering or registering is lawful and in accordance with the Data Protection Act 1998. We do not sell or pass on customers details to any other business or organization for any purpose other than for processing your order with us.
10.2 Where there is sufficient evidence to suggests that fraud may be taking place (details given differ from that the credit/debit card company hold) we reserve the right to pass the information to the relevant authorities.
11. Complaints
11.1 We pride ourselves on the high standard of service that we provide our customers but if you believe that you have cause for complaint about a product or a service that you have received from Positive Lighting Solutions please e mail sales@positivelightingsolutions.co.uk our customer service department. We aim to respond to all complaints within 3 working days where possible and then proceed to resolving the problem as soon as possible for you at sales@positivelightingsolutions.co.uk
In using this website you accept that you are responsible for maintaining the confidentiality of your account and password and responsible for preventing unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure your password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or could be used in an unauthorised manner.
Your Details
When you register your details at this Website you warrant that the Personal Information that you provide when you register as a customer, during a transaction or subsequently update is true, accurate, current and complete in all respects. It is your responsibility to update this information (using the Your Details section of the site) as soon as you become aware of any changes. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
Site Conduct
You must not use the website in such a way that is likely to cause any kind of disruption or damage to the website or its level of service.
Your use of our site must be for lawful purposes and not in connection with any fraudulent or criminal activity.
You alone are responsible for the communications sent from your computer and you should not communicate any material that is inaccurate, illegal, or offensive.
Products & Prices
Every attempt is made to portray items as accurately as possible, although slight variations may occur. Some items may require self-assembly and all measurements are a guideline.
The reproduction of colour is as accurate as photographic and publishing procedures will allow. Please be aware that there may be differences in colour depending on individual screen calibration and our website colours.
All prices are accurate at the time of publishing and exclude VAT. All prices are subject to adjustment including any changes to the rate of VAT. You will be notified of any price changes at the time of placing an order.
Stock Availability
All items are subject to availability. Whilst every effort is made to keep our stock levels up to date, there may be occasions where items you have ordered are not available. Should this occur you will be contacted by email in order to seek your instructions. Where one or more item is out of stock will only be shipped once all of the items are back in stock.
Website Availability
We will endeavour to ensure that the website is available at all times and that its content downloads to you without error, however due to the limitations of the Internet this cannot always be guaranteed. Maintenance to our systems may also necessitate the suspension of services at certain times, however we will try our utmost to minimise such occurrences.
Accessing the website
You are granted a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it, except with our written permission. Resale, commercial use; downloading, copying and automated data gathering from this website or its contents is expressly forbidden.

Positive Lighting Solutions, and the logos portrayed in the site are the property of Positive Lighting Solutions.
Products & Prices
Product images shown on our website are for guidance purposes only and are not necessarily indicative of the product we supply. If you have any questions regarding the exact look, finish and design of the product you require please contact us here. All prices are subject to adjustment including any changes to the rate of VAT. You will be notified of any price changes at the time of ordering. We reserve the right to modify or withdraw products and their specification at any time.
Your Contract with Us
When you place an order online with this site you are making an offer to buy goods. We will then send you an email acknowledging that we have received your order.
Once we have checked stock availability and prices we will send you our dispatch email to confirm we have accepted the order and that a contract has been made with us. It is only on the dispatch of the goods and our acceptance of your order that we will take payment from you.
When a delivery is delayed due to stock availability or unforeseen factors (including pricing errors), we will advise you of delay within 24 hours of receiving your order. We will provide an estimate of the likely dispatch date and allow you to cancel your order if this is unacceptable. We will not take your payment at this stage nor will there be a contract with us. If goods are no longer available we will advise you of this by email, and there will be no contract between us.
Cancellation & Returns
You can cancel your contract at any time up to 7 working days after the date of delivery. To do so, please email us or write to us giving a brief outline of the reasons for which you are rejecting the goods. To cancel the goods you must return them to us at your own expense ensuring they are packaged adequately to prevent damage in transit. If you prefer us to arrange collection we will make arrangements with our carriers and deduct the cost of carriage (which is equivalent to the dispatch carriage cost) from your refund.
If you fail to return the goods we will collect them and deduct the cost of collection from your refund. Also, if you fail to take reasonable care of the goods before they are returned to us and damage or deterioration occurs we will charge you for their reduction in value.
This cancellation policy does not affect your statutory rights.
Faulty Goods
If the goods are in any way defective you should contact us immediately. We will deal with this in accordance with your legal rights.
Changes to Terms & Conditions
We reserve the right to make changes to these Terms & Conditions and other documents, policies or website content at any time. You will be subject to the Policies and Conditions of Use & Sale in force at the time that you use the website or order goods from us.
Communicationing with us
When communicating or transacting with us you do so electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive electronic communications from us and that all agreements, notices, disclosures and other communications served by us electronically have the same legal bearing as they would if served in writing. This does not affect your statutory rights.
Force Majeure
We cannot be held responsible where we are unable to comply with our obligations due to events beyond our control. This does not affect your statutory rights.
Jurisdiction
All contractual and legal dealings are in accordance with the Law of England & Wales.
Limitation of Liability
Positive Lighting Solutions is not responsible or liable to any person or entity whatsoever for any direct or indirect loss, damage (whether actual, consequential, punitive, special, or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based upon or resulting from any information or opinions provided on the site or from the use of, or the inability to use, the materials on the site.
